PREAMBLE
These general terms and conditions of sale govern the contractual relationship between PHILIPPE ZORZETTO – Creator and Distributor of the products – and its consumer customers (hereinafter referred to as the "Customer(s)"), who acknowledge having read them before placing an order and expressly accept them without reservation. The term “consumer” refers to a natural person placing an order not related to their professional, commercial, or independent activity.
The general conditions and prices may be modified or updated at any time. The terms and prices applicable to the purchase of a product on the Website are those in effect on the date of the order.
Only the French version of these general terms and conditions of sale shall be legally binding on PHILIPPE ZORZETTO. If any provision of these terms becomes null or unenforceable, the validity of the other provisions shall not be affected. The invalid or unenforceable provision will then be replaced by the applicable legal provision.
PRODUCTS
The information and characteristics of the products correspond to the specifications available at the time of their publication or update on the website and are provided for information purposes only. In the event of an error, PHILIPPE ZORZETTO cannot be held liable.
The photographs illustrating the products are not contractual. In particular, the color tones of images may vary depending on each Customer’s screen settings and resolution. PHILIPPE ZORZETTO shall not be responsible if a perceived color differs from the actual product delivered. Therefore, the sale cannot be cancelled on this basis, except under the return or withdrawal conditions set forth in Article 6 of these terms.
REGISTRATION AND ORDER PROCESS
Registration on the Website is required before placing any order. Registration is free of charge and may be cancelled at any time. The information provided by the Customer when placing an order is binding: in the event of an error in the delivery address, PHILIPPE ZORZETTO cannot be held responsible for the impossibility of delivering the product.
Order process: The selected product(s) are added to the Customer’s cart. The Customer then selects the delivery option and clicks the “Next step” button. They confirm or enter their address and click “Next step.” They confirm the delivery method, accept the general terms and conditions of sale by checking the designated box, and click “Next.” They then choose the payment method. In the case of payment by check or bank transfer, the Customer must click the “I confirm my order” button.
Automatic recording systems are considered valid proof of the nature, content, and date of the order. PHILIPPE ZORZETTO confirms acceptance of the order by email to the address provided by the Customer when creating their account. The sale is concluded only upon confirmation of the order. PHILIPPE ZORZETTO reserves the right to cancel any order from a Customer with whom a dispute exists, particularly regarding payment for a previous order.
PRICES AND SHIPPING COSTS
Prices are expressed in euros, inclusive of all taxes (VAT) for deliveries within France, and exclusive of taxes for deliveries outside France.
The prices displayed on product pages do not include shipping. Shipping costs are automatically calculated based on the total weight of the goods, the destination, and the chosen delivery option. These costs are added to the product price.
For deliveries within the rest of the European Union and worldwide (other than mainland France, Corsica, and Monaco), the conditions of the “International and Overseas Mail & Parcel Guide” apply. Furthermore, for deliveries outside mainland France, the Customer agrees to pay all applicable customs duties and taxes required by the laws of the destination country for importing products. PHILIPPE ZORZETTO cannot be held liable if the Customer fails to pay these duties and taxes.
For stock availability reasons, an order may be shipped in multiple parcels. In this case, the Customer will only be charged once for shipping. If the Customer wishes to have products delivered to two different addresses, they must place two separate orders, each with its own shipping charges.
PAYMENT
The Customer may choose to pay by check or credit card.
Secure credit card payment allows transactions to be processed via a banking server in a secure environment (SSL). Your credit card number is transmitted directly to the bank’s servers, and the transaction is processed securely without passing through the store’s server—ensuring that your information is known only to our banking partner.
Regardless of the payment method chosen, payment will be considered final only after full receipt of the funds. Fees associated with payments from non-EU countries are not covered. In the event of a transaction refusal by banking institutions, the order will be automatically cancelled, and the Customer will be notified by email. You agree to receive your invoices exclusively in electronic form.
SHIPPING AND DELIVERY TIMES
PHILIPPE ZORZETTO undertakes to make every effort to process your orders as quickly as possible. However, delivery times are given for information purposes only and depend on the delivery method chosen by the Customer. They may be extended in cases of force majeure, unforeseen circumstances as defined by French case law, or causes beyond our control, including any fault attributable to the Customer. Force majeure events releasing the seller from its delivery obligation include war, riots, fire, strikes, accidents, and supply chain disruptions. If the impediment lasts longer than four (4) weeks, either party may terminate the contract without compensation.
In general, delivery delays do not entitle the Customer to any damages or compensation.
